Mustafa Nili, a lawyer, announced that the First Branch of the Revolutionary Court in Shiraz has sentenced Benjamin Naqdi to death on the charge of "corruption on earth."

In an interview with Emtedad, Nili stated that Benjamin Naqdi was arrested on the evening of January 3rd in Shiraz for igniting a fire extinguisher towards law enforcement officers.

According to this lawyer, the initial charge of "attempted murder" was communicated to his client, but it was later changed to "moharebeh" (waging war against God).

He added that after the preliminary investigations were completed, the indictment against Benjamin Naqdi was issued with charges of "moharebeh," "membership in groups disrupting national security," "conspiracy and collusion with the intent to commit a crime against national security," and "propaganda against the regime." Nili mentioned that a decision to dismiss the prosecution was issued regarding the charges of "causing bodily harm to officers" and "carrying a cold weapon."

Nili also stated that the judges of the First Branch of the Revolutionary Court in Shiraz, during the proceedings, recognized the set of charges as constituting "corruption on earth" and based on this, issued the death sentence for Benjamin Naqdi.

The lawyer for Benjamin Naqdi, referring to his and his colleagues' intention to appeal this ruling, said they would file a request for cassation within the legal timeframe. He expressed hope that, given that no individual was harmed during the incident in question and that his client's actions do not constitute corruption on earth, the ruling would be overturned by the Supreme Court.

مصطفی نیلی، وکیل دادگستری، اعلام کرد شعبه اول دادگاه انقلاب شیراز بنیامین نقدی را با اتهام «افساد فی‌الارض» به اعدام محکوم کرده است.

نیلی در گفت‌وگو با امتداد گفت که بنیامین نقدی شامگاه ۱۳ دی‌ماه در شیراز به دلیل شعله‌ور کردن یک کپسول آتش‌نشانی به سمت ماموران نیروی انتظامی بازداشت شد.

به گفته این وکیل دادگستری، در ابتدا اتهام «شروع به قتل» به موکلش تفهیم شد، اما پس از آن اتهام وی به «محاربه» تغییر یافت.

او افزود پس از پایان تحقیقات مقدماتی، کیفرخواست بنیامین نقدی با اتهام‌های «محاربه»، «عضویت در گروه‌های برهم‌زننده امنیت کشور»، «اجتماع و تبانی به قصد ارتکاب جرم علیه امنیت کشور» و «فعالیت تبلیغی علیه نظام» صادر شد. به گفته نیلی، در خصوص اتهام‌های «ایراد صدمه جسمانی به ماموران» و «حمل سلاح سرد» قرار منع تعقیب صادر شده بود.

نیلی همچنین گفت قضات شعبه اول دادگاه انقلاب شیراز در جریان رسیدگی، مجموعه اتهام‌های مطرح‌شده را مصداق «افساد فی‌الارض» تشخیص داده و بر همین اساس حکم اعدام برای بنیامین نقدی صادر کرده‌اند.

وکیل بنیامین نقدی با اشاره به قصد خود و همکارانش برای اعتراض به این رای گفت که در مهلت قانونی درخواست فرجام‌خواهی خواهند کرد. او ابراز امیدواری کرد که با توجه به این که به گفته وی در جریان رخداد مورد اشاره هیچ فردی آسیب ندیده است و اقدامات موکلش مصداق افساد فی‌الارض نیست، حکم صادره در دیوان عالی کشور نقض شود.
