Karim Khan, the chief prosecutor of the International Criminal Court, has been suspended from his position following investigations into allegations of "sexual misconduct." The oversight body of the International Criminal Court announced this news on Monday evening, June 18, stating that the decision to suspend Khan was made after the disciplinary proceedings regarding the allegations of "sexual misconduct" in his case reached a conclusion.

Karim Khan, a prominent British lawyer, has repeatedly denied these allegations, which were first raised in 2024.

The oversight body of the International Criminal Court stated that the executive committee of this body has voted to refer Khan's case to a special meeting of member states to decide on his professional future. The committee, composed of representatives from 21 member countries, has reached the conclusion by a necessary majority that Khan has committed a "serious violation" in connection with the allegations of sexual misconduct.

These allegations were made by a woman who worked for Khan at the court's headquarters in The Hague. The emergence of these claims in 2024 caused turmoil and a crisis during his management of the court's prosecution division.

The decision to refer the case to the 125 member countries of the court is considered an unprecedented action in the history of this international judicial body and could ultimately lead to a vote on the prosecutor's removal from office. The governing body of the court emphasized in a statement that Khan's suspension "does not imply a determination of the final outcome of the case."

Khan had previously temporarily stepped back from managing part of the court responsible for investigating and prosecuting individuals accused of international crimes. The statement noted that the executive committee made its decision based on a report from a UN oversight body, the opinion of a panel of legal experts, and written submissions from both Khan and the complainant. This ruling is the latest development in a process that has involved the International Criminal Court for nearly two years.

Earlier, the Associated Press had reported on a series of sexual allegations against Karim Khan, which he has denied. نهاد ناظر بر دیوان کیفری بین‌المللی شامگاه دوشنبه ۱۸ خرداد ضمن اعلام این خبر افزود تصمیم به تعلیق کریم خان پس از آن اتخاذ شد که روند رسیدگی انضباطی به اتهام «سوءرفتار جنسی» در پروندهٔ او به مرحلهٔ نتیجه‌گیری رسید.
کریم خان، وکیل برجسته بریتانیایی، بارها این اتهام‌ها را که نخستین‌بار در سال ۲۰۲۴ مطرح شد، رد کرده است.

نهاد ناظر بر دیوان کیفری بین‌المللی می‌گوید کمیتهٔ اجرایی این نهاد رأی داده است پرونده خان به نشست ویژه کشورهای عضو ارجاع شود تا آن‌ها دربارهٔ آینده حرفه‌ای او تصمیم‌گیری کنند.
کمیتهٔ متشکل از نمایندگان ۲۱ کشور عضو دیوان با اکثریت لازم به این نتیجه رسیده که خان در ارتباط با اتهام‌های سوءرفتار جنسی مرتکب «تخلف جدی» شده است.

این اتهام‌ها از سوی زنی مطرح شده که در مقر دیوان در شهر لاهه برای خان کار می‌کرد.
طرح این ادعاها در سال ۲۰۲۴ باعث آشفتگی و بحران در دورهٔ مدیریت او بر بخش دادستانی دیوان شد.

تصمیم ارجاع پرونده به ۱۲۵ کشور عضو دیوان اقدامی بی‌سابقه در تاریخ این نهاد قضایی بین‌المللی محسوب می‌شود و می‌تواند در نهایت به رأی‌گیری دربارهٔ برکناری دادستان از سمتش منجر شود.
نهاد حاکم بر دیوان در بیانیه‌ای تأکید کرد که تعلیق کریم خان «به معنای تعیین نتیجهٔ نهایی پرونده نیست».

خان پیش‌تر نیز به‌طور موقت از مدیریت بخشی از دیوان که مسئول تحقیق و پیگرد افراد متهم به جنایات بین‌المللی است، کنار رفته بود.
در این بیانیه آمده است که کمیتهٔ اجرایی تصمیم خود را بر اساس گزارش یک نهاد نظارتی سازمان ملل، نظر هیئتی از کارشناسان قضایی و همچنین لوایح کتبی ارائه‌شده از سوی خان و فرد شاکی اتخاذ کرده است.
این رأی تازه‌ترین تحول در روندی است که نزدیک به دو سال دیوان کیفری بین‌المللی را درگیر کرده است.
