The Emtedad website reported that the conviction of Pejman Jamshidi to endure 99 lashes for the charge of "illicit relationship" has been definitively confirmed after being reviewed by the Supreme Court.

Elham Mohammadi, a reporter for Emtedad, quoted Melika Parsadoust, the complainant in this case, stating that the Ninth Branch of the Tehran Criminal Court issued this ruling, and after an appeal, the 29th Branch of the Supreme Court also upheld the ruling exactly.

According to this report, the charge in the case was examined based on Article 637 of the Islamic Penal Code (punitive section). According to this article, the punishment for an illicit relationship is up to 99 lashes, and in cases where the act was carried out under coercion and violence, this punishment is only considered for the coercive individual. Emtedad reported that the Criminal Court and the Supreme Court have only sentenced Pejman Jamshidi to endure 99 lashes in this case.

Melika Parsadoust, referring to the finalization of this ruling, stated that the issuance of the final verdict shows that the "false narratives" surrounding this case have no basis.

She also emphasized that she will not allow what has happened to her to be redefined by other narratives and stated that she has described this incident as "sexual violence" from the beginning.

Parsadoust further mentioned that although this ruling does not alleviate the harm inflicted on her, in a situation where, according to her, proving sexual violence in Iran is difficult, the court's acknowledgment that the relationship was "without consent and accompanied by coercion and violence" is significant for her and other women who have had similar experiences.

In conclusion, she pointed out the legal shortcomings and difficulties in pursuing such cases, stating that despite her personal opposition to the implementation of corporal punishment, she will pursue the case to the end and expressed hope that this case will encourage other women who have faced sexual violence to break their silence.

وب‌سایت امتداد گزارش داد حکم محکومیت پژمان جمشیدی به تحمل ۹۹ ضربه شلاق به اتهام «رابطه نامشروع» پس از رسیدگی در دیوان عالی کشور به طور قطعی تایید شده است.

الهه محمدی، خبرنگار امتداد، به نقل از ملیکا پارسا دوست، شاکی این پرونده، نوشت شعبه نهم دادگاه کیفری یک تهران این حکم را صادر کرده و پس از اعتراض و فرجام‌خواهی، شعبه ۲۹ دیوان عالی کشور نیز رای صادره را عینا تایید کرده است.

بر اساس این گزارش، اتهام مطرح شده در پرونده بر مبنای ماده ۶۳۷ قانون مجازات اسلامی (بخش تعزیرات) بررسی شده است. طبق این ماده، مجازات رابطه نامشروع تا ۹۹ ضربه شلاق است و در مواردی که عمل با اکراه و عنف انجام شده باشد، این مجازات تنها برای فرد اکراه‌کننده در نظر گرفته می‌شود. به گفته امتداد، دادگاه کیفری یک و دیوان عالی کشور در این پرونده تنها پژمان جمشیدی را به تحمل ۹۹ ضربه شلاق محکوم کرده‌اند.

ملیکا پارسادوست با اشاره به قطعی شدن این حکم گفت صدور رای نهایی نشان می‌دهد «فضاسازی‌های دروغین» درباره این پرونده، پایه و اساسی نداشته است.

او همچنین تاکید کرد اجازه نخواهد داد آنچه بر او گذشته با روایت‌های دیگر بازتعریف شود و گفت از ابتدا این اتفاق را «خشونت جنسی» توصیف کرده است.

پارسادوست در ادامه گفت هرچند این حکم از آسیب‌های وارد شده به او نمی‌کاهد، اما در شرایطی که به گفته او اثبات خشونت جنسی در ایران دشوار است، احراز این موضوع از سوی دادگاه که رابطه «بدون رضایت و همراه با اکراه و عنف» بوده، برای او و دیگر زنانی که تجربه مشابه داشته‌اند اهمیت دارد.

او در پایان با اشاره به کاستی‌های قانونی و دشواری‌های پیگیری چنین پرونده‌هایی گفت با وجود مخالفت شخصی‌اش با اجرای مجازات‌های بدنی، پرونده را تا پایان پیگیری خواهد کرد و ابراز امیدواری کرد این پرونده زنان دیگری را که با خشونت جنسی روبه‌رو شده‌اند، به شکستن سکوت تشویق کند.
